On April 5, 2016, the FDA finalized the seventh core Food Safety Modernization Act (FSMA) ruling, which is the Sanitary Transportation of Human and Animal Food Rule.

This particular ruling requires that businesses involved in transporting human and animal food, by motor or rail vehicle, abide by a set of rules on maintaining sanitary conditions when transporting food.

[/minti_headline][vc_column_text]According to the FDA website, the final ruling on Sanitary Transportation is applicable to the following parties handling and transporting food by motor or rail:

  • Shippers
  • Receivers
  • Loaders
  • Carriers

Exceptions to the Rule:

  • Exporters who ship food through the US (ie. from Canada to Mexico) if the food doesn’t enter U.S. distribution.
  • Companies involved in the transportation of food intended for export are covered by the rule until the shipment reaches a port or U.S. border

  • Vehicles and equipment must be designed that makes it ‘cleanable.’
  • Temperature must be kept under appropriate levels when transporting food that require temperature control.
  • Required monitoring of vehicle temperature in order to avoid ‘dangerous’ temperature zones.
  • Upon shipper’s request, food transporters must be able to provide temperature reporting.
  • Storage of transport vehicles must not promote pest infestation or contamination.

  • Carriers are required to train personnel in sanitary transportation practices and create training documentation.

  • Vehicle and equipment must meet all sanitary requirements specified by the shipper.
  • To prevent microorganism growth during transport, carriers will need to provide a cold storage compartment with specifications outlined by the shipper.
  • Carriers are now required to share the following information to these shippers when requested:
    1. Verification that appropriate temperature conditions were maintained during food transport.
    2. Information regarding the 3 previous cargoes carried in the vehicle.
    3. The date of the most recent cleaning of the vehicle.

  • Carriers must be able to record their procedures for:
    1. Cleaning and inspecting food transport vehicles
    2. Complying with food Transport Temperature control

  • Carriers must be able to ensure that proper temperature conditions were maintained during transport and provide verification of temperature conditions to the receiver.
  • Shippers will need to outline proper sanitation and temperature requirements for food transportation.

Small Businesses

  • Business other than motor carriers, who are not also shippers and/or receivers and employ less than 500 people OR have motor carriers carrying less than $27.5 million in annual receipts would have to comply 2 years after the publication of the final rule. (April 5, 2018)

Large Businesses

  • Businesses that are not otherwise categorized under this ruling’s ‘small businesses’ have 1 year to comply after the publication of the final rule. (April 5, 2017)
